Abusive practices in debt collection

Not long ago I had a very typical, I was going through my morning email clients and opposing counsel, sorting through email and have a meeting with staff and partners about our daily work tasks. However, later this morning I found a blog published by a debt of well known and widely distributed organization of the collection, InsideARM. The blog has been scandalously titled, "Guns do not kill people, people kill debt collectors? Intrigued (and always interested in reading about the new industry tips and tricks they use to try to deceive consumers) to read.

The editor of the blog, Michael Klozotsky, wrote an entire blog in a recent New York Times article on the recent tragic deaths in Connecticut by Omar Thornton. Mr. Klozotsky believes that industry debt recovery has been wrongfully characterized by an interest in the events that led to the tragic death. The editor apparently noted the Times statement that Mr. Thornton had financial difficulties throughout his life and debt recovery (stunning) "I hunted for years." Mr. Klozotsky wrote, "but the article goes on so the story continues and is transmitting a clear message, but true nonetheless: .. The debt collection industry is to blame for these unnecessary deaths. "

What Mr. Klozotsky, frankly, that the New York Times and U.S. consumers are really so stupid as to think that is only because abuse and harassment by debt collectors, Mr. Thornton has decided to pull their colleagues and possibly himself? I hope not. Perhaps Mr. Kolozotsky should pass more time reading the Fair Debt Collection Practices Act rather than the New York Times. Doing so would have read that when Congress wrote and passed the FDCPA, considered that: "There is abundant evidence of the use of abusive, deceptive and unfair debt collection by debt collectors for many. Practices abusive debt collection contribute to the number of personal bankruptcies, loss of internal instability, jobs, and invasions of privacy. "

It is very clear that Congress, consumer advocates like Consumer Consumer Law Center, and certainly believe that the country of violence and recovery illegal debt can lead to serious disruption of life such as divorce, bankruptcy and invasions of privacy. I think we all agree that the disturbances land can infuse outbreak as intolerable amount of stress and disaster in your life. However, despite these specific findings by Congress in the 1970 (I think we all agree that collectors are more violent and aggressive these days), Mr. Klozotsky that debt collectors need a break. Really? Debt collection industry generates billions of dollars a year at the expense of consumers who work hard trying to survive in an economy very unstable and unpredictable.

Let me be clear: not raising abuses led directly to the tragic death in Connecticut? Of course not! However, not the debt collection industry deserve you leave alone? Of course not!
